By joining the Disney+ Perks Loyalty Program (the “Program”) you agree to the following terms and conditions (“Terms and Conditions”). These Terms and Conditions incorporate The Walt Disney Company Terms of Use (“TWDC Terms of Use”). For purposes of interpreting the TWDC Terms of Use in connection with the Program, the “Disney Services” means the Program. If any provision in these Terms and Conditions conflicts with any provision in the TWDC Terms of Use, the conflicting provision in these Terms and Conditions will control. Capitalized terms used but not defined herein will have the meanings provided in the TWDC Terms of Use.

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. THESE TERMS GOVERN YOUR PARTICIPATION IN THE PROGRAM. BY PARTICIPATING IN THE PROGRAM, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS.

OVERVIEW

As a Disney+ subscriber, you have the opportunity to take advantage of special offers and promotions (collectively, "Perks") via our Disney+ Perks site (the “Perks Site”). These Perks are offered by Disney and the partners listed on our Perks Site. In order to be eligible to access the Perks Site and redeem the Perks, you must be located in a country or territory where we make the Perk Site available, have an active Disney+ subscription and log in with your MyDisney Account using the email that is associated with your Disney+ subscription. You may be asked to provide a Perks member name and other information if you elect to participate in certain Perks, including sweepstakes and giveaways. Participation is optional. To enroll, please visit perks.disneyplus.com and log in with your MyDisney Account using the email that is associated with your Disney+ subscription. You may withdraw from the Program at any time by logging in to perks.disneyplus.com, navigating to your Settings page, and selecting ‘Opt-out of Disney+ Perks.’ Then, follow the prompts.

Because we process your personal information when we provide the Perks, this may be interpreted as a “financial incentive” under California law or a “bona fide loyalty program” under Colorado law. The value of the personal information that we collect is reasonably related to the expenses related to offering you the Perks. Additional information regarding our collection, use, and disclosure of personal information, including to offer the Perks, is provided in our Privacy Policy and notice of Your US State Privacy Rights. If you ask us to delete your personal information as described in our Your US State Privacy Rights notice, we will not be able to provide you with access to this Program to validate your eligibility for the Perks.

GENERAL PROGRAM PARTICIPATION

Redemption. In order to take advantage of an individual Perk, you must follow the redemption instructions provided on the Perks Site.

Disney reserves the right to modify, substitute, or otherwise change the number of Perks, the requirements for redemption, and the benefits pertaining to a specific Perk from time to time, at its sole discretion.

Availability. Perks are subject to change, availability, and other terms and conditions (including expiration) as may be communicated from time to time on the Perks site, prior to and/or upon redemption. Expired Perks cannot be redeemed.

Transferability. Membership in the Program and any related benefits are not transferable and may not be combined or merged with any other subscriber’s account or with any other Disney loyalty program.

THIRD PARTY PROMOTIONS

Program Affiliates. Any dealings, promotions, transactions, et al. by and between Perks members, third party advertisers and other third party vendors (collectively, “Program Affiliates”) via the Program, or participation in promotions, including the delivery of and the payment for goods and services, and any other terms, conditions, warranties, or representations associated with such dealings, are solely between the Perks member and Program Affiliate or other third party. Disney is not responsible or liable for any part of any such dealings or promotions.

Linked Destinations and Advertising. If we provide links or pointers to other websites or destinations, you should not infer or assume that we operate, control, or are otherwise connected with these other websites or destinations. When you click on a link within the Perks Site, we may not warn you that you have left the Perks Site and are subject to the terms and conditions (including privacy policies) of another website or destination. These Terms and Conditions do not govern your use of another website or destination. We are not responsible for the content or practices of any website or destination other than the Perks Site, and even if the website or destination is operated by a company affiliated or otherwise connected with the Program. By using the Perks Site, you acknowledge and agree that we are not responsible or liable to you for any content or other materials hosted and served from any website or destination other than the Perks Site.

RULES AND CONDUCT

As a condition of use, you hereby promise that you will not use the Program for any purpose that is unlawful, commercial in nature (such as, for example, raising money for anyone, advertising or promoting any product, service, pyramid scheme or other venture) or prohibited by these Terms and Conditions or any other agreement, or any other purpose not reasonably intended by Disney. You agree to abide by all applicable local, state, national and international laws, regulations and rules. Without limiting the foregoing, you shall not use the Program for the purpose of money laundering, bid rigging, price fixing or other unlawful collusion, price signaling or exchange of competitively sensitive data or information.

LOSS OF PERKS; TERMINATION OF YOUR PARTICIPATION IN THE PROGRAM

Disney may revoke your ability to participate in the Program due to: (i) your abuse of the Program, including, without limitation, your use of any automated means to participate in the Program or to earn Perks; (ii) your failure to follow these Terms and Conditions, the TWDC Terms of Use, the Disney+ Subscriber Agreement, and any other terms and conditions applicable to the Program; (iii) the attempted or actual sale of any of your Perks or your Program account; (iv) any misrepresentation by you; (v) suspension or termination of your Disney+ subscription; (vi) any suspected illegal or fraudulent activity; (vii) any other conduct deemed by Disney, in its sole discretion, to be an abuse of the Program, to be detrimental to the interests of Disney, its parents, subsidiaries, affiliates, licensees, suppliers, or its customers, or to be otherwise improper. If your ability to participate in the Program is revoked, any unredeemed Perks will automatically expire and be forfeited and your future participation in the Program may be prohibited, to the extent permitted by law. In addition, Disney will have the right to take administrative or legal action as it deems appropriate.

Disney is not responsible for redeemable Perks that expire or are lost or redeemed due to illegal, fraudulent or unauthorized activity.

MODIFICATION, SUSPENSION OR TERMINATION OF PROGRAM

We reserve the right, in our sole discretion and at any time, without prior notice, to modify, suspend or terminate any or all aspects of the Program. Disney makes no guarantee or representation as to the length of time during which the Program will be offered, and the Program could end at any time.

PERKS DISPUTES

All questions or disputes regarding eligibility for the Program, collecting or redemption of Perks, or your compliance with the Terms and Conditions will be resolved by Disney, in its sole and absolute discretion. All redemptions are final. Perks will not be refunded or placed back in a user’s account for any reason after redemption has been made, including, if you return an item purchased using your Perks.
