1. Eligibility: The Sweepstakes is only open to entrants who, at the time of entry and throughout the Sweepstakes Period and prize fulfillment period as set forth below, are: (a) natural persons who are legal residents of the 50 United States or the District of Columbia; and (b) at least 18 years of age (or the age of majority in their jurisdiction of residence, whichever is or older). Entrants must not be an employee or director, or IRS dependent, immediate family member or individual residing in the same household of, an employee or director, of Disney Streaming Services LLC ("Sponsor" or "Disney+"), Probability LLC ("Administrator"), Epsilon Data Management, LLC ("Epsilon"), New York Comic Convention ("Comic Con") or their respective parent, subsidiary and affiliated companies, advertising, promotion, fulfillment or production agencies, or promoting the Comic Con Convention (including presenters, performers and other talent appearing at the 2025 New York Comic Con Convention) or anyone involved in the selection of the winners (collectively, "Sweepstakes Entities"). Void where prohibited or restricted by law. Subject to all applicable federal, state, and local laws and regulations. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s and Administrator’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning is contingent upon fulfilling all requirements set forth herein.

If selected as a potential winner, the Entrant and any potential guests over the age of eighteen (18) will be required to consent to a background check to verify eligibility; and, failure to sign such consents and authorizations and/or to furnish all required information will result in disqualification without compensation of any kind. In addition, Sponsor and Administrator reserve the right in their sole discretion to disqualify the potential winner or their potential guest (without explanation or compensation of any kind) if the results of such background check reveal that potential winner or their potential guest(s) do not meet the Sweepstakes eligibility requirements or has been charged with a felony or misdemeanor, a crime of moral turpitude or an act of insurrection, or any other act that might reflect negatively on Sponsor, Administrator or any of the Sweepstakes Entities, as determined by the Sponsor or Administrator in their sole discretion. All such decisions of Sponsor and Administrator are final and binding in all respects and not subject to appeal.

4. Sweepstakes Entry: The Sweepstakes begins at 9:00 AM Pacific Time ("PT") on September 9, 2025 and ends at 8:59 AM PT on September 23, 2025 ("Sweepstakes Period"). Epsilon's computer is the Sweepstakes’ official clock.

5. How to Enter: During the Sweepstakes Period, there are two (2) ways to enter the Sweepstakes:

A. Method #1 - Disney+ Subscriber Online Entry: To enter via this method of entry, you must be a Disney+ subscriber, with an online MyDisney account to enter online. Navigate the internet to https://perks.disneyplus.com ("Website"). You will need to log in using your MyDisney account email address associated with your Disney+ subscription (the "Account"); or, if you do not have an online MyDisney account, you will need to create an account. You may create an account for free by visiting the Website, clicking on the "Create an Account" link and providing the requested information on the registration form through the "Create Your Disney Account" section on the Website. You must register for the Sweepstakes through the Website. Once you are logged into your Account, you may enter the Sweepstakes by navigating to the "Discover" page, clicking on the "New York Comic Con Sweepstakes" image, and following the instructions within the Website to enter.

CLICK THE CHECKBOX SIGNIFYING THAT YOU MEET THE SWEEPSTAKES ELIGIBILITY REQUIREMENTS, HAVE READ AND AGREE TO THESE OFFICIAL RULES AND THE SPONSOR’S TERMS OF USE (HTTPS://WWW.DISNEYPLUS.COM/LEGAL/TERMS-OF-USE). IF YOU DO NOT CHECK THE BOX INDICATING YOUR AGREEMENT TO THE ABOVE, YOU WILL NOT BE ENTERED IN THE SWEEPSTAKES AND CANNOT WIN A PRIZE. DO NOT CHECK THE BOX WITHOUT FIRST REVIEWING THESE RULES AND SPONSOR’S TERMS OF USE. Then, click the designated button to submit your entry. Once you click "Enter" where indicated, you will receive one (1) entry into the Sweepstakes. Proof of inputting information at the Website is not considered proof of delivery to or receipt by Sponsor, Epsilon or Administrator. Receipt of entry may be acknowledged but such acknowledgment does not constitute a representation by Sponsor, Epsilon or Administrator as to eligibility of entry and is not otherwise binding upon Sponsor, Epsilon or Administrator.

B. Method #2 – Free Alternate Method of Entry Form ("AMOE"): To enter the Sweepstakes without becoming a Disney+ subscriber, individuals who are eligible as per above may send an e-mail to disneyplusentry@probabilityworks.com. The subject line of the e-mail must contain "Entry: New York Comic Con Sweepstakes." The body of the e-mail must contain your full name, city and state, and an answer to the question "Who is your favorite Disney, Marvel or Star Wars character?". (DO NOT INCLUDE ANY CONTENT OR COMMENTARY IN ADDITION TO THE NAME OF YOUR FAVORITE DISNEY, MARVEL OR STAR WARS CHARACTER.) E-mail must be received by 9:59 AM PT on September 23, 2025 to be eligible. Normal internet access and usage charges imposed by your internet service provider may apply. Proof of sending e-mail is not considered proof of delivery to or receipt by Sponsor, Epsilon or Administrator. Without limitation, Sponsor, Epsilon and Administrator are not responsible if e-mail is not timely received or received at all due to operation of e-mail service provider’s security settings or any other reason. Receipt of entry may be acknowledged but such acknowledgment does not constitute a representation by Sponsor, Epsilon or Administrator as to eligibility of entry and is not otherwise binding upon Sponsor, Epsilon or Administrator

Limit of one (1) entry per person per day during the Sweepstakes Period, regardless of method of entry. For the purposes of this Sweepstakes, a "day" is defined as beginning at 12:00 AM (midnight) PT and ending at the following 11:59 PM PT (except for the first day of the Sweepstakes Period [9/9/2025], which begins on/about 9:00 AM PT and ends at 11:59 PM PT, and the last day of the Sweepstakes Period [9/23/2025] which begins at 12:00 AM PT and ends at 8:59 AM PT).  Multiple Entries received from any person beyond this entry limit will void all such Entries. Entries generated by a script, macro, or other automated means or by any means that subverts the entry process will be disqualified. Entries that do not conform to or that violate these Official Rules (including entries made via Method #2 which do not include the name of one (1) Disney, Marvel or Star Wars character and no additional content/commentary) or are submitted in any manner other than stated in these Official Rules will be disqualified.

*IMPORTANT: Data rates may apply if Sweepstakes entry is submitted via your mobile device according to the terms and conditions of your service agreement with your wireless carrier. Other charges may apply (such as normal airtime and carrier charges as well as charges for wireless Internet access) and may appear on your mobile phone bill or be deducted from your prepaid account balance. Wireless carriers' rate plans may vary, and you should contact your wireless carrier for more information on messaging/data rate plans and charges relating to your participation in this Sweepstakes. Mobile device service may not be available in all areas. Check your device's capabilities for specific instructions.

6. Winner Selection and Odds: Potential winners will be selected from among all eligible entries received during the Sweepstakes Period in a random drawing conducted by the Administrator. The drawing will take place approximately two (2) hours after conclusion of the Entry Period (i.e., on or about 12:00 p.m. (Noon) PT on September 23, 2025). The drawing will be conducted by Administrator, an independent judging organization/administrator whose decisions are final and binding on all matters related to the Sweepstakes. Sweepstakes is available to millions of internet users. Odds of winning depend on the total number of eligible entries received during the Sweepstakes Period.

7. Winner Notification: Potential winner will be notified by the Administrator via e-mail on or about September 23, 2025. Potential winner must respond to the email within twenty-four (24) hours thereof (or such shorter period of time as indicated thereon) confirming their interest and availability to attend the event (as defined in section 9 below), or such potential winner may be disqualified without compensation of any kind and an alternate potential winner will be selected (time permitting).

IF ADMINISTRATOR IS SUCCESSFUL IN CONTACTING POTENTIAL WINNER:

Before being declared a winner ("Winner"), potential prize Winner will be required to complete, sign and return within forty-eight (48) hours of date on notification (or such shorter period of time as indicated thereon) an Affidavit of Eligibility, Liability Release and Indemnification, a Publicity Release where allowed by law, a tax acknowledgment, and the necessary paperwork for a background check, as well as other documents that Sponsor may require (collectively the "Prize Claim Documents"). Failure to respond to the initial notification within forty-eight (48) hours after notification (or such shorter period of time, as applicable), return of e-mail notification as undeliverable after two (2) attempts, or failure to return the completed and signed Prize Claim Documents within the indicated time period will result in disqualification, prize forfeiture and selection of an alternate potential winner from among all remaining eligible entries received (time permitting).

In the event of any dispute concerning the identity of any entrant, the Entry will be deemed submitted by the natural person who is the authorized account holder of the email address associated with the Account (for entries made via Method #1) or the email address from which the email Entry was submitted (for entries made via Method #2), as applicable. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

WINNERS WILL BE ISSUED AN IRS FORM 1099-MISC FOR TAX PURPOSES IN THE AMOUNT OF THE ACTUAL FAIR MARKET VALUE OF THE PRIZE (AS SET FORTH IN SECTION 8 BELOW) AND MUST SUBMIT THEIR SOCIAL SECURITY OR TAX ID NUMBER, AS APPROPRIATE, AS REQUIRED BY LAW. ALL FEDERAL, STATE, AND LOCAL INCOME TAXES INCURRED IN CONJUNCTION WITH ACCEPTANCE OF THE PRIZE ARE SOLELY THE RESPONSIBILITY OF THE WINNERS.

8. Prize and Approximate Retail Value ("ARV"): There is one (1) prize available to be won.

Prize: Prize Winner will receive a 6-day/5-night trip ("Trip") for the winner and up to four (4) guests (each a "Guest"; collectively, "Guests") to attend New York Comic Con scheduled for October 9-12, 2025, at the Javitz Center in New York, NY. ("Event"). Prize Winner and their guests must be available to travel October 8-13, 2025. If Grand Prize winner cannot do so for any reason, Grand Prize will be forfeited without compensation of any kind, and an alternate winner may be selected as per Section 6 (time permitting). The Trip includes: roundtrip coach air transportation for up to five (5) from a major commercial airport near Grand Prize winner’s legal residence (as selected by the Sponsor/Administrator) ("Departure Airport") to a New York area airport (with possible layovers/flight may not be direct) ("Destination City Airport"); ground transportation to/from Destination City Airport and hotel awarded as $500 cash or cash equivalent to Winner; five (5) nights’ hotel accommodations (up to two [2] standard rooms for up to five [5] people), up to five (5) Sidekick tickets to the Event valid for October 9-12, 2025, and ground transportation to/from hotel and Event.

Sidekick tickets are valid for October 9-12, 2025 and include:

○      Access to 400+ exhibitors on our Show Floor, creators in Artist Alley and authors in Writers Block

○      Access to engaging content across 8+ panel rooms and 2 premier stages*

○      Access to celebrity photo ops and autographing (additional fees for photos and autographs are not included) 

○      Interactive show features across New York Comic Con

○      Access to studio and brand activations providing photo opportunities, prizes and giveaways, interactive activities and more

*This does not include separately ticketed events. Reservations may be required.

ARV of Grand Prize: $9,550.00.

The actual value of the Prize may vary depending on a number of factors, including Departure Airport, Destination City, date, times of travel, and fluctuations of rates and airfares at the time of travel booking, and the number of travelers. Therefore, the actual value of the Prize awarded may be lower or higher at the time it is fulfilled. If the actual value of the Prize is less than the stated estimated value, the difference will not be awarded. Winner will not receive compensation for any element(s) of the Prize that Winner or Guest(s) are unable to use for any reason, and such unused portion(s) of the Prize will be forfeited.

All costs and expenses not expressly stated in the Trip description above are excluded and solely the responsibility of Winner or Guests, including but not limited to: roundtrip transportation between the Winner’s residence and Departure Airport, roundtrip transportation between Winner’s residence and the hotel if Winner resides within one hundred and fifty (150) miles of the Destination City (and, in such case, Winner will not receive any alternate prize or compensation of any kind relative to ground transportation replacing air travel), baggage fees, airport departure fees and taxes; travel insurance; hotel room service; parking fees; laundry service; food; alcoholic beverages; merchandise and souvenirs; local and long distance telephone calls; tips, gratuities, service charges, resort fees or taxes; or all other charges not explicitly stated as being included in the Trip.

See below for additional conditions and restrictions regarding the Prize: 

Sweepstakes Entities will not replace any lost, mutilated or stolen tickets, travel vouchers or certificates. Prize elements may not be separated. Trip is for the Winner and up to five (5) Guests of Winner's choosing. Once Guest(s) is/are selected by Winner, Guest(s) cannot be changed without the express consent of  Sponsor, which may be withheld for any reason. If the Winner chooses to bring less than the allotted number of Guests, the Trip will be awarded in increments suitable for the actual number of participants with no substitute Trip or compensation provided to the Winner. The preceding includes a Prize Winner receiving only a quantity of tickets to the Event corresponding to the actual number of travelers.

If Trip includes airfare, the Winner and Guest(s) must travel together on the same itinerary, and air transportation must be roundtrip from/to the Departure Airport (with possible layovers). Sponsor/Administrator will determine airline and flight itinerary in their sole discretion. Airline carrier’s regulations and conditions apply to air travel. Airline tickets are nonrefundable, non-transferable, are not valid for upgrades or frequent flyer miles, and no codeshare flights may be used. The Winner and Guest(s) are responsible for providing proper documentation to travel which may include a REAL I.D. or passport. No one-way trips allowed. Unless otherwise necessitated by Sponsor, no stopovers are permitted on tickets issued; if a stopover otherwise occurs, the Prize will terminate and full fare will be charged from the stopover point for the remaining trip segment(s), including the return. Winner is solely responsible for any and all baggage charges, taxes and any other charges incurred after or in connection with the issuance of airline tickets. Prize travel is subject to capacity controls, availability and certain other restrictions, which may include a Saturday-night stay, all of which are subject to change. Airfare may not include government taxes, Passenger Facility Charge or September 11th Security Fee. Other travel restrictions and blackout dates may apply. All airline tickets are subject to the vagaries of flight variation, work stoppages, and schedule or route changes. The roundtrip air transportation element for any Prize travel begins and ends at the point of departure. 

In addition, Winner and Guests must comply with any applicable hotel check-in requirements, such as presentation of photo identification and a major credit card (and should Winner not have a credit card/payment instrument with sufficient available credit/funds to pay for a hotel stay of five [5] nights (or in such other amount as prescribed by hotel), Winner agrees to sign additional documents and/or take other steps prescribed by Sponsor and/or Administrator, upon request and without compensation of any kind, so as to protect Sponsor and Administrator from incurring any liability for damage to the hotel room caused during the hotel stay by Winner and their Guest[s].) Other hotel fees not expressly mentioned are not included and if applicable may be payable at the time of check-out by the Winners/Guest(s).

Guest(s) (if a minor in their jurisdiction of residence, their parent or legal guardian) must sign a Release and Indemnification and a Publicity Release (where allowed by law) and if over eighteen (18) years of age, the necessary paperwork for a background check prior to issuance of travel documents. If any Guest of Prize Winner is a minor, the Winner or one of the Winner’s other allotted Guests must be such minor’s parent or legal guardian (as applicable).

Sponsor reserves the right to condition award of Prize upon the results of a background check on Winner and their guests. Winner and guests, agree to fully cooperate in the conduct of such background check, timely providing any additional materials, information and consents requested by Sponsor or Administrator, with the understanding that Sponsor may refrain from awarding the Prize (or, allowing guest(s) to accompany  Winner on the Trip, as the case may be) without liability of any kind if Sponsor determines in its sole discretion that the past conduct of  Winner and/or guests would disparage or adversely affect the goodwill and business reputation of Sponsor and/or its products. Winner and their guests further understand and agree that any decision by Sponsor as to the results of a background check is final and binding.

No substitution of Trip or any elements thereof is allowed, except at Sponsor's sole discretion. The Winner will not receive compensation for any element(s) of the Trip (including, without limitation, Event tickets) that any participant(s) is unable to use for any reason, and any portion of the Trip not accepted or used by Winner will be forfeited. 

Trip components may not be sold, traded, transferred or refunded. Trip is not redeemable for cash. Trip is non-commissionable. Trip is awarded "as is" with no warranty or guarantee, expressed or implied, being provided by the Sweepstakes Entities. Sweepstakes Entities are not liable for any expenses incurred as a consequence if any component of the Trip, including flights, are delayed, postponed, or cancelled for any reason; and, in such case, Winner will not be reimbursed and no substitution will be provided except as in Sponsor's sole discretion. Prize and its components (including, without limitation, Event tickets) cannot be used in conjunction with any other promotion or offer, separated, sold, exchanged or redeemed for cash, traded, transferred, substituted, assigned, used for commercial purposes, or rescheduled to dates other than as set forth above, except in Sponsor’s sole and absolute discretion, and any unused element of the Prize will be forfeited.

If any portion of the Prize is not available for any reason, then the Sponsor reserves the right to substitute that portion of the Prize with another prize of comparable or greater value. The Winner will not receive compensation for any element(s) of the Prize/Trip that any participant(s) is unable to use for any reason, and such unused portion(s) of the Trip will be forfeited.

Type of ticket to New York Comic Con are of Sponsor’s sole determination. Tickets are provided to Winner and their Guest(s) pursuant to a revocable, nontransferable license that is personal to Winner/Guests and may not be sold, resold, auctioned, bartered, assigned, exchanged, placed in commerce, transferred, given away, donated, or otherwise conveyed. Attending New York Comic Con constitutes agreement of Winner/Guests (if a minor in their jurisdiction of residence, the parent/legal guardian of such Guest) to the terms of such license, including (a) recovery (if any) in the event that New York Comic Con is cancelled or postponed for any reason; and (b) compliance with all applicable laws and regulations as well as venue policies, including those intended to prevent the spread of COVID-19/Coronavirus (e.g., mask-wearing, provision of proof of vaccination, provision of proof of negative COVID-19/Coronavirus test**).

Winner and guest must abide by all venue and event policies, including but not limited to, showing a valid photo ID at venue for identification purposes if requested. Comic Con reserves the right to revoke full or partial prize from Winner or Winner’s guests who it and/or venue/Convention personnel deem may, in their sole discretion, be intoxicated, be a safety risk, have violated any venue/Convention policy or law, and/or may bring Comic Con into disrepute. Resale of tickets is prohibited. Should the Convention be cancelled, you will be notified as soon as reasonably possible. In the event the Winner and/or their Guest(s) engage in behavior that, as determined by Sponsor/New York Comic Con in its sole and absolute discretion, is obnoxious or threatening, illegal, is intended to annoy, abuse, threaten or harass any other person, or is contrary to Sponsor's (or its affiliates') property rules or policies in effect at the time of New York Comic Con, Sponsor reserves the right to terminate the Trip or other applicable experience early, in whole or in part, and send the Winner and/or their Guest(s) home with no further compensation. Winner acknowledges and agrees to be solely responsible for any actions, claims or liabilities of any member of their group.

Should the Event be cancelled for any reason beyond the control of Sponsor and (e.g., natural disaster, riot, civil commotion, pandemic/epidemic, act of terrorism), the liability of Sponsor shall be limited to award of the remaining elements of the Prize (i.e., 6-day/5-night trip for Winner and Guest(s) to Destination City).

Any images of Prize/Prize components in advertising are for illustrative purposes only and actual items awarded as prize/prize components may differ from such images; and Sweepstakes Entities expressly disclaim any and all liability in conjunction therewith. 

In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes promotional materials and the terms and conditions of these Official Rules, these Official Rules shall prevail and govern.

9. Limitations on Liability: By entering, entrants agree that Sweepstakes Entities and their respective parents, subsidiaries and affiliated companies, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents (collectively "Released Parties") will have no liability whatsoever, and shall be released and held harmless by entrants, for any injuries, claims, losses or damages of any kind to persons, including death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of Prize or participation in this Sweepstakes or participation in any Sweepstakes-related activity, including travel, or entrant’s failure to comply with the Official Rules. The Released Parties shall not be liable to Winners or any other person for failure to supply the Prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulation(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond the Released Parties’ control. The Released Parties are not responsible for failed, partial or garbled computer transmissions, or for technical failures of any kind affecting the Sweepstakes in any manner, including but not limited to electronic malfunction or damage of any network, hardware or software. If for any reason the Sweepstakes is not capable of running as planned, including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud or technical failures beyond Sponsor’s control that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes (including entries or otherwise), Sponsor reserves the right, in its sole discretion, to disqualify any individual, whether or not the individual is a participant in the Sweepstakes, who tampers with the entry process, and to terminate, modify or suspend the Sweepstakes. In such event, Sponsor reserves the right to conduct the Sweepstakes and award the Prizes by means of a random drawing from among all eligible entries received prior to and/or after (as appropriate) the action taken by Sponsor or otherwise in a manner which is fair, appropriate and consistent with these Official Rules, as determined by Sponsor in its sole discretion. Notice of termination/modification/suspension of Sweepstakes will be posted on the Website. No responsibility is assumed for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or loss, destruction or unauthorized access to, or alteration of, entries; or any problems or technical malfunctions of any telephone network or lines, computer or internet online systems, servers, or providers, computer equipment, software, failure of any e-mail or electronic entry or participation to be received on account of technical problems or traffic congestion on the Internet or at any website/platform, or any combination thereof, including any injury or damage to any person's computer related to or resulting from participation in or downloading any materials from this Sweepstakes. Failure of Sponsor or Administrator to enforce any provision of these Official Rules shall not constitute the waiver of such provision.

Entrants further agree not to knowingly damage or cause interruption of the Sweepstakes and/or prevent others from participating in the Sweepstakes. CAUTION: ANY ATTEMPT TO DAMAGE ANY ONLINE SERVICE, WEBSITE OR PLATFORM OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES, MAY VIOLATE CRIMINAL OR CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE, SPONSOR MAY DISQUALIFY ANY PERSON, WHETHER OR NOT THE INDIVIDUAL IS A PARTICIPANT IN THE SWEEPSTAKES, MAKING SUCH ATTEMPT AND SEEK DAMAGES TO THE FULLEST EXTENT OF THE LAW.

Except where legally prohibited, Winners grant (and agree to confirm in writing) permission for the Released Parties to use such Winner's name, photograph, voice, likeness, and/or statements made by, or attributed to the Winner in all media now known or hereafter discovered, worldwide, including, without limitation, on the World Wide Web, without notice, review or approval or further compensation and in perpetuity.

WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS SWEEPSTAKES, INCLUDING THE PRIZES, IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.

10. Disputes/Choice of Law: Except where prohibited, entrants  agree that: (a) any and all disputes, claims, and causes of action arising out of or connected with the administration of this Sweepstakes, or the awarding of prizes/determination of the prize Winners, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration pursuant to the Rules of JAMS, then effective (notwithstanding the foregoing, entrant  shall not be precluded from seeking relief in small claims court for disputes/claims within the scope of the jurisdiction of small claims court and any remedies available to entrant  under applicable federal, state or local law remain available to entrant  and are not waived pursuant to this section); (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys’ fees; and (c) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased and any and all rights to injunctive relief. The arbitrator hearing such dispute/claim/cause of action shall be neutral and the entrant will have a reasonable opportunity to participate in the selection of the arbitrator. Such arbitration will take place at a location near the entrant’s  residence and the entrant has the right to an in-person hearing in the arbitration proceeding, if desired. The arbitration will allow for the discovery and/or exchange of non-privileged information between entrant and Sponsor. Should an entrant initiate arbitration pursuant to this section, the entrant shall be responsible for JAMS’s fees to do so (approximately, $250), with all other costs of such arbitration being borne solely by Sponsor. If entrant is a California resident and Sponsor is the prevailing party in such arbitration, such entrant will not be responsible for Sponsor’s costs and fees in conjunction with the arbitration proceeding; BUT, IN ALL OTHER CASES, ENTRANT WILL BE RESPONSIBLE FOR SUCH COSTS/FEES IF REQUIRED BY THE ARBITRATOR’S RULING. For the avoidance of doubt, the requirement to arbitrate disputes pursuant to this section is reciprocal and binding both upon entrants and Sponsor. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and/or Released Parties in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New York, without regard for conflicts of law doctrine of New York or any other jurisdiction and all proceedings shall take place in the City of New York, County of New York (except as otherwise provided herein).
